We represent clients in lots of various relationships such as life partners, domestic relationships, married couples etc.
With a married couple, we put language in our agreements regarding conflicts that arise when we represent both people.
In the future if there is a conflict in the party, then we may only be able to represent one person and not both.
In elder law we see this when one spouse gets a diagnosis and is struggling to take care of themselves and the other spouse reaches out to us to discuss the consequences.
In one example, if one spouse gets a diagnosis of dementia and is trying to continue to drive or taking out money from their account etc then we can advise the spouse about the power of attorney.
Those whom are listed as power of attorney are acting in a fiduciary capacity, meaning they should be making decisions in the best interest of the party.
We encourage open conversations and to even plan ahead and have those conversations before any diagnosis might happen.
