On Friday, October 16th, Attorney, Candice Joy answers the question of why do I need a trust if everything is joint?
Short answer: You don’t
Long answer: When one of you passes, if everything is joint, it will pass seamlessly to the surviving spouse. However, when the surviving spouse then passes, there won’t be additional beneficiaries.
So either you can do planning now, or wait for the surviving spouse to do planning after the passing of their spouse.
